Terms & Conditions
ABOUT THESE TERMS
These Terms and Conditions ("Terms") apply to all services provided by Kresko Studio ("Kresko", "we", "us") to you ("Client", "you"), and to your use of our website at kreskostudios.space. Our services include branding, social media management, advertising, content creation, photo and video shoots, video editing, post-production, web design, and SEO. By booking our services, paying an invoice, signing a proposal, or using our website, you agree to these Terms. If we sign a separate written agreement with you, that agreement applies together with these Terms, and if the two conflict, the signed agreement prevails.
QUOTES AND PROPOSALS
Each project begins with a written quote or proposal that describes the services, deliverables, timeline, and price. Quotes are valid for [14] days unless stated otherwise. A project is confirmed once you accept the quote in writing (email or signed document is fine) and pay any advance we ask for. Anything not listed in the quote is outside the scope of the project and may be charged separately. If you ask for extra work or changes to the scope, we will give you an updated quote before starting.
What to include in the T&C document
Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
To learn more about this, check out our article “Creating a Terms and Conditions Policy”.
PAYMENT
Unless the quote says otherwise, we require an advance of [50]% to confirm the booking, with the balance due [on delivery / within 7 days of the invoice date]. For larger projects, we may split payment into milestones. Prices are in [INR / your currency] and do not include taxes such as GST or VAT, which will be added where applicable. Advance payments are non-refundable once we have started work or reserved dates, crew, or equipment for you.
If an invoice is not paid by its due date, we may charge interest of [1.5]% per month on the overdue amount, pause all work, and withhold final files until payment is received. Third-party costs such as advertising spend, stock footage, music licences, models, locations, equipment rental, travel, and printing are not included in our fees unless the quote says so. Ad spend is paid directly to the advertising platform or to us in advance, as agreed.
CLIENT RESPONSIBILITIES
To do our best work, you agree to give us accurate information, brand assets, scripts, approvals, and feedback on time. Delays on your side may delay delivery and may affect the schedule of other work, and we are not responsible for missed deadlines caused by late input or approvals. You confirm that you own or have the right to use everything you give us, including logos, text, images, music, and footage, and that it does not infringe anyone else's rights.
SHOOTS AND PRODUCTION
For photo and video shoots, we will agree the date, time, location, crew, and requirements with you in advance. Unless we agree otherwise, you are responsible for getting access to the location and any permits or permissions needed to shoot there, and for making sure that any people you provide, such as staff, models, or customers, have agreed to be filmed or photographed. We may ask people appearing in a shoot to sign a release form.
If you want to reschedule a shoot, please give us at least [48] hours' notice. Rescheduling with less notice, or cancelling a shoot, may result in a charge of up to [50]% of the shoot fee to cover crew and equipment already booked. If a shoot cannot go ahead because of weather, safety concerns, or events outside our control, we will work with you to find a new date without extra charge for our time, though third-party costs already incurred may still apply. Extra shoot hours beyond those quoted will be charged at [rate] per hour. We reserve the right to stop a shoot if conditions are unsafe or if anyone's safety, dignity, or the law is at risk.
EDITING, REVISIONS, AND APPROVALS
Each quote includes a set number of revision rounds for editing and design work, usually [2] rounds. A revision means changes to existing work within the agreed brief, not a new concept, new footage, or a change in direction. Additional revisions or changes to the brief will be charged at [rate] per hour or as quoted. Please send all feedback in one consolidated message per round to avoid confusion and delays. Once you approve a deliverable in writing, or use it publicly, we treat it as final. If you do not respond to a delivery or a request for feedback within [7] days, we may treat the work as approved.
DELIVERY AND FILES
We will deliver finished work in the formats listed in the quote, through a download link, cloud folder, or other agreed method. Timelines in quotes are estimates and depend on timely feedback and approvals. Unless the quote says otherwise, we deliver the final edited files only, and not raw footage, original project files, or working files. Raw footage and project files can be provided on request for an additional fee. We keep raw footage and project files for [1 to 2] months after delivery, after which we may delete them, so please keep your own backup of everything important.
OWNERSHIP AND USAGE RIGHTS
We own all concepts, ideas, drafts, and working files until you have paid in full. Once you have paid in full, you own the final deliverables created specifically for you and may use them for the purposes and in the territories and period described in the quote. Any third-party materials, such as stock footage, music, fonts, plugins, and templates, are licensed under their own terms, and the licence may restrict how you can use them. Where the quote states a limited usage licence for models, music, or talent, you must stay within it.
We keep the right to use our own tools, methods, templates, and general know-how. Unless you tell us in writing that your project is confidential, we may display finished work in our portfolio, website, and social media to promote our studio. We will not share anything you ask us to keep private.
SOCIAL MEDIA, ADVERTISING, AND SEO SERVICES
Where we manage your social media, run ads, or work on SEO, we will use reasonable skill and care, but we cannot guarantee specific results such as follower numbers, sales, rankings, reach, or return on ad spend. Results depend on many factors outside our control, including platform algorithms, competition, market conditions, and your product or service. You are responsible for the legality and accuracy of claims made in your marketing, including product and pricing claims. We may need access to your accounts, and you agree to give us the access needed, which we will use only for your project. Platforms such as Meta, Google, and YouTube may suspend or restrict accounts or ads at their discretion, and we are not responsible for decisions made by those platforms.
WEB DESIGN
For web design projects, you must give us content, images, and approvals on time. Once the site is live, ongoing hosting, domain renewals, maintenance, and security updates are your responsibility unless covered by a separate maintenance agreement. We are not responsible for problems caused by third-party plugins, hosting providers, or changes made to the site by others after launch.
CONFIDENTIALITY
Each of us agrees to keep the other's non-public business information confidential and to use it only for the project. This does not apply to information that is already public, that we are legally required to disclose, or that was developed independently. We require freelancers and partners who work on your project to follow the same confidentiality standard.
CANCELLATION AND TERMINATION
You may cancel a project by giving us written notice. If you cancel, you must pay for all work completed up to that point, any non-refundable third-party costs, and any cancellation charges set out in these Terms or the quote. We may pause or end a project if you do not pay invoices on time, repeatedly delay approvals, ask us to do something unlawful or unsafe, or act abusively towards our team. If we end a project for reasons other than your breach, we will refund any advance payment for work not yet carried out, after deducting costs already incurred.
REFUNDS
Because our work is creative and custom, we do not offer refunds once work has begun, except where we have failed to deliver what the quote promised and cannot fix the issue within a reasonable time. If you are unhappy with a deliverable, please tell us within [7] days of delivery so we can try to put it right through the agreed revision process.
LIMITATION OF LIABILITY
We will provide our services with reasonable skill and care. To the fullest extent the law allows, we are not liable for indirect or consequential losses, loss of profit, loss of business, or loss of data. Our total liability to you for any claim related to a project will not exceed the amount you paid us for that project. We are not liable for loss or damage to footage or files after delivery, for delays or failures caused by events outside our control, or for any third-party platform, tool, or service. Nothing in these Terms limits liability that cannot be limited by law.
INDEMNITY
You agree to cover our reasonable costs and losses arising from any claim that materials you provided, or claims you asked us to make in your marketing, infringe someone's rights or break the law.
EVENTS OUTSIDE OUR CONTROL
Neither of us is responsible for delays or failures caused by events outside reasonable control, such as natural disasters, severe weather, illness, accidents, power or internet failures, government restrictions, strikes, or failures of third-party platforms. We will tell you as soon as we reasonably can and work with you to find a fair way forward.
USE OF OUR WEBSITE
You may use our website for lawful purposes only. You must not copy, scrape, or reuse our content, designs, or portfolio work without our written permission, try to interfere with the site's security or operation, or use it to send spam or harmful material. Our website may link to third-party sites, and we are not responsible for their content or privacy practices. Our Privacy Policy explains how we handle personal information.
CHANGES TO THESE TERMS
We may update these Terms from time to time. The date at the top shows when they were last changed. Updated Terms apply to new projects from that date, and projects already agreed will continue under the Terms in force when you accepted the quote, unless both of us agree otherwise.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of India. If a dispute comes up, we ask that you contact us first so we can try to resolve it informally within [30] days. If we cannot, the courts of [your city, state or country] will have jurisdiction.
